(1)Applicable objects

（一）适用对象

1.The employer has the legal person status and has the ability to carryout the work of employing foreign experts.

1.聘请单位具有法人资格，有开展聘请外国专家工作的能力。

2.Have a clear task to work in China.

2.有明确的来华工作任务。

3.Have a detailed schedule for activities in China.

3.有详细的在华活动日程。

4.There are sufficient fees to protect foreign experts from China.

4.有充足的费用保障外国专家来华。

5.Those who meet the requirements of foreign high-end talents (Class A)or meet the requirements of the Notice on Further Improving theRelevant Procedures for Foreign Experts' Short-term Visit in China(No.176,2015) can apply for the invitation letter of foreign expertsto China.

5.符合外国高端人才（A类）或符合《关于进一步完善外国专家短期来华相关办理程序的通知》（外专发〔2015〕176号）文件规定的，可申请外国专家来华邀请函。

2.Notice of the State Administration of Foreign Experts Affairs on theIssuance of The Work License Service Guide for Foreigners in China(Interim) (No.36,2017).

2.国家外国专家局关于印发《外国人来华工作许可服务指南（暂行）》的通知（外专发〔2017〕36号）。

(3)Standards for providing materials

（三）提供材料标准

1.All color original and Chinese translations of paper materials shallbe uploaded to the work management service system of foreigners inChina.

1.所有纸质材料彩色原件及中文翻译件均须以电子方式上传至外国人来华工作管理服务系统。

2.Non-Chinese certification materials should be provided in Chinesetranslation and stamped with the official seal of the employer(except passport or international travel documents).

2.非中文证明材料均需提供中文翻译件，并加盖用人单位公章（护照或国际旅行证件除外）。

3.There is no need to submit paper materials to the acceptance windowfor verification.

3.无需提交纸质材料到受理窗口核验。

(4)Required materials

（四）所需材料

1.The application letter of Invitation for Foreign Experts to China(including the basic information of the applicant, the reason forarrival, the time of stay in China, the fee arrangement, thecommitment of the authenticity of the invitation behavior and theguarantee for the payment of the invited foreign experts in China),which shall be stamped with the official seal of the company.

1.《外国专家来华邀请函》申请函（内容应包括申请人基本信息、来华事由、在华停留时间、费用安排和用人单位对邀请行为的真实性作出承诺及对被邀请外国专家在华费用支付等进行担保），需盖单位公章。

2.The application form of Invitation to Foreign Experts in China shallbe stamped with the official seal of the company.

2.《外国专家来华邀请函》申请表，需盖单位公章。

3.Foreign expert passport or international travel documents.

3.外国专家护照或国际旅行证件。

4.The copy of the short-term employment contract or dispatch(invitation) letter shall be stamped with the official seal of thecompany and signed by the legal person or the person in charge of theforeign affairs department.

4.短期聘用合同或派遣（邀请）函复印件，需盖单位公章，法人或外事部门负责人签字。

5.Other certification materials deemed necessary by the issuingauthority (for example, relevant certification materials should besubmitted for high-end talents (Class A)).

5.发证机关认为需要的其他证明材料（例如，符合高端人才（A类）的应提交相关证明材料）。

(5)Matters needing attention

（五）注意事项

1.Apply for F visa with the invitation letter from foreign experts toChina, and do not need to apply for work residence certificate afterentry.

1.持外国专家来华邀请函申请F 字签证，入境后无需办理工作类居留证件。

2.According to the laws and regulations of China, if the applicantshall be pre-approved by the competent department of the industry orhave the corresponding professional qualification in China, theapproval documents or professional qualification certificate of thecompetent department of the industry shall also be provided.

2.我国法律法规规定应由行业主管部门前置审批或具备我国相应准入类职业资格的，还应提供行业主管部门批准文书或职业资格证明。

3.Employers and foreigners should ensure the authenticity of thesubmitted commitments, and actively cooperate with the examinationand approval authorities to check the supervision during and afterthe event. For those who provide false promises, the examination andapproval authorities shall have the right to cancel administrativedecisions according to law, and suspend the handling of work permitsby employers, agencies and foreigners, and deal with those involvingviolations of laws and regulations.

3.用人单位和外国人应确保提交承诺内容的真实性，并积极配合做好各审批机关约谈及事中事后监管的核查工作。对提供虚假承诺的，审批机关有权依法取消行政决定，并暂缓用人单位、代办机构及外国人办理外国人来华工作许可业务，涉及违法违规的依法处理。

(6)Handling procedures

（六）办理程序

1.The employer of foreign experts shall apply in the management servicesystem of foreigners in China.

1.外国专家的聘请单位在外国人来华管理服务系统中提出申请。

2. The handling authority shall accept the application of theemployer and inform the employer of the acceptance result within 5working days (the date of submitting the materials shall not becounted within the period).

2.办理机关对聘请单位的申请进行受理，并在5 个工作日（材料提交当日不计算在期间内）内向聘请单位告知受理结果。

3.After the acceptance institution accepts the application online, thedecision institution shall examine and make a decision within 5working days from the date of acceptance, and shall no longer submitpaper materials for verification.

3.受理机构网上受理后，决定机构应当自受理之日起5个工作日内进行审查并作出决定，不再提交纸质材料核验。

4.If the decision is made, the handling authority shall issue theInvitation Letter from Foreign Experts to China.

4.决定通过的，由办理机关签发《外国专家来华邀请函》。

5.Foreign experts shall apply to the Chinese visa authorities for an Fvisa of no more than 90 days (inclusive) with the Invitation Letterof Foreign Experts to China and relevant materials.

5.外国专家持《外国专家来华邀请函》及相关材料，向我驻外签证机关申请来华停留时间不超过90 天（含）的F字签证。

(7)Time limit for examination and approval

（七）审批期限

Acceptanceperiod: 5 working days (subject to the complete materials submittedby the employer online).

受理期限：5个工作日（以用人单位网上提交完整并符合要求的材料为准）。

Theperiod of review and decision: 5 working days (starting from the dateof acceptance).

审查决定期限：5个工作日（以受理之日起开始计算）。

Ifthe period needs to be extended under special circumstances, thelicensing accepting institution or the decision institution will dealwith it as appropriate.

遇特殊情况需延长期限的，许可受理机构或决定机构将酌情处理。
